General Terms and Conditions NEM-O BV

  1. Application: These General Terms and Conditions apply to all activities performed for the client by care providers affiliated with private practice NEM-O, Kerkstraat 112, 3850 – Nieuwerkerken, company number BE 0790.936.119. No other terms and conditions apply to these activities, unless expressly accepted in writing.
  2. Services: Private practice NEM-O offers psychodiagnostics and other services in the field of mental health care. All care providers affiliated with private practice NEM-O perform their services with the necessary knowledge and care. However, this always concerns an obligation of means and not an obligation of results.
  3. Remuneration: Every service provided by care providers affiliated with private practice NEM-O to the client is subject to remuneration for the services and costs. The rates for these services are explicitly stated on the website https://praktijknem-o.be/index.php/en/home-en/.
    Certain services are exempt from VAT. For services subject to VAT, the amount excluding VAT is always stated.
  4. Payment: The client will be invoiced for the services provided.
    Certain services will be charged before they are provided. If a service has been paid for in full or in part in advance, the amount already paid will be deducted from the outstanding amount.
    Invoices are payable within 30 days. In the event of late payment, interest on arrears of 10% of the outstanding amount shall be payable by operation of law and without notice of default, with a minimum of EUR 100 and a fee of EUR 35 for administrative costs.
    Intakes are to be paid within 48h after booking in order to be considered as definitive. Without timely payment the appointment will be cancelled.
    Invoices must be disputed within 10 days of the invoice date, stating the reason. Payment of the invoice is considered acceptance.
  5. Cancellation: The client may cancel appointments at any time and without compensation up to at least 48 hours in advance. In the event of repeated cancellations without valid reasons, private practice NEM-O reserves the right to suspend or terminate the service.
    In the event of late cancellation (= less than 48 hours in advance), half of the amount due for the service will be charged.
    In case of no-show without cancellation, the full amount due for the service will be charged. An exception to this is when the absence is for medical reasons, with a medical certificate as proof.
  6. Free participation: The client decides voluntarily and on their own responsibility to enter into a professional relationship with care providers affiliated with private practice NEM-O.
    Exceptions to this are when the collaboration is established at the request of a client with legal authority, or when the client does not have their own decision-making authority and is represented by parents, guardian, partner, or judge.
  7. Ethics: The psychologists affiliated with private practice NEM-O are recognized as clinical psychologists and bound by professional ethics.
  8. Confidentiality: All files are treated as strictly confidential.
    Any deviations from this (e.g., reporting to the treating physician or psychiatrist, discussion with parents or partner, etc.) require the client’s verbal consent.
    Confidentiality can only be breached if the client could endanger themselves or others.
  9. Liability: Subject to the legal obligations of private practice NEM-O and the care providers affiliated with the practice, the client remains responsible for their own decisions and actions. Neither the practice nor its care providers can be held liable for these decisions and actions.
    The care providers affiliated with private practice NEM-O are each insured for professional liability. The client acknowledges and accepts that any compensation for damage resulting from professional errors is limited to the amount for which the care provider is insured.
  10. Force majeure: Private practice NEM-O makes every effort to process and deliver files in a timely manner. However, the private practice and its care providers are not liable if circumstances beyond its control require it to deviate from this. In the event of persistent force majeure, the private practice is entitled to suspend or terminate its services.
  11. Intellectual property rights: Private practice NEM-O retains the intellectual property rights to its name, logo, photos, texts, and other materials offered by the practice. These may not be used without prior permission.
  12. Privacy: Any processing of personal data by private practice NEM-O and by care providers affiliated with the practice is carried out in accordance with the General Data Protection Regulation and applicable national law.   13. Amendments: These General Terms and Conditions are subject to change at any time. The most recent version will always be posted on the website https://praktijknem-o.be/index.php/en/home-en/. If no objection is received within 14 days of notification of changes, the changes will be deemed to have been accepted.
    The possible invalidity or nullity of one of these provisions does not result in the nullity of other provisions.
  14. Applicable law and competent court: These provisions are subject to Belgian law.
    The client undertakes to first report any complaints to private practice NEM-O in writing, verbally, or by email within 10 working days of the service to which the complaint relates, with a view to finding a solution by mutual agreement.
    The client may also contact the Psychologists’ Commission.
    If mutual consultation does not provide a solution, the Court of First Instance of Limburg, Hasselt Division, has jurisdiction over legal disputes between the client and care providers affiliated with private practice NEM-O.
